Immigrant Eligibility Fact Sheet

The following is a guide. SRS will determine if a non-citizen qualifies for benefits.

Cash, Child Care and Medical: Under certain conditions, legal non-citizens living in the State of Kansas may qualify for cash, child care, and medical assistance if they are:

  • Refugees
  • Asylees
  • Non-citizens whose deportation has been withheld
  • Cuban or Haitian entrants
  • Admitted as an Amerasian immigrant
  • Lawful permanent residents who entered the country on or before August 22, 1996
  • Lawful permanent residents who are honorably discharged veterans (includes the spouse and dependent children)
  • Persons granted parole or conditional entry status who entered the country on or before August 22, 1996
  • Persons with a pending or approved Violence Against Women Act case who entered the country on or before August 22, 1996

For medical only:

  • American Indians born in Canada under specific circumstances

The following non-citizens who entered the U.S. after August 22, 1996 qualify five years after their date of entry:

  • Lawful permanent residents
  • Person granted parole or conditonal status
  • Person who do not meet one of the two above criteria but who have a pending or approved Violence Against Women Act case

All other non-citizens who do not meet one of the above criteria are not eligilbe for cash, child care, and medical coverage but may qualify for emergency medical coverage.

Food Assistance: Under certain conditions, legal non-citizens living in the State of Kansas may qualify for food assistance.

Legal non-citizens with one of the following statuses may qualify for food assistance if they are:

  • Refugees
  • Asylees
  • Non-citizens whose deporation has been withheld
  • Cuban or Haitian entranst
  • Amerasian immigrants
  • Lawful permanent residents who meet one of the following:
    1. Receiving benefits for blindness or disability
    2. Were 65 year or older on August 22, 1996
    3. Are under 18 years of age
  • Honorable discharged veterans or on active duty in the U.S. Armed Forces
  • Members of a Hmong or Laotion tribe who rendered assistance to U.S. personnel during the Vietnam era

The following non-citizens who entered the U.S. after August 22, 1996 qualify five years after their date of entry:

  • Lawful permanent residents
  • Person granted parole or conditional status
  • Persons who do not meet one of the two above criteria but who have a pending or approved Violence Against Women Act case

All other aliens who do not meet the above criteria will be ineligible for food assistance benefits, but other family members may qualify if they meet the criteria above or are citizens (such as children born in the U.S.).
